of the brebizz platform




Article 1: Legal information


1.1 Platform operator


The brebizz platform is operated by an entity registered in France under the number 527 924 005 00046, whose head office is located at 9 Rue du Centre, 62170 Écuires.

Subject to VAT under the number: FR65 527 924 005.

Scheme: Sole proprietorship — digital service activity.

1.2 Purpose


The brebizz platform offers services for establishing commercial relationships between influencers and brands, as well as the management of advertising spaces and digital campaigns.

Article 2: Purpose of the General Terms and Conditions of Sale (GTC)


2.1 Definition and scope of the GTC


These General Terms and Conditions of Sale (GTC) define the rights and obligations of the contracting parties, namely brebizz, partner brands and influencers using the platform. They govern all transactions, exchanges and services provided by brebizz in connection with influencers and brands to promote products.

2.2 Scope of application of the GTC


These terms and conditions apply to all users of the brebizz.com platform, whether brands or influencers, and cover all the services offered, including the subscription of a VIP profile, promotional campaigns, promotional campaigns, transactions and commission payments.


Article 3: How brebizz operates


3.1 Platform concept


brebizz is the first *free-shop* platform dedicated to influencers, operating according to a model where the influencer himself chooses the products to be promoted. Unlike other platforms, where brands offer products, brebizz allows influencers to select products that interest them and that match their personal needs.

3.2 Benefits for brands


This model is an advantage for brands, as it ensures that the influencer is genuinely interested in the products being promoted, making the promotional campaign more authentic and more effective.

3.3 Influencer autonomy


The influencer enjoys great autonomy in the management of his collaborations, with the freedom to choose the products that suit him and to manage his partnerships as he pleases, which reinforces the authenticity of his recommendations.

3.4 Networking and collaboration framework


brebizz ensures a smooth relationship between brands and influencers, by offering a structured framework for collaborations. A 10% commission is applied to the amount of the discount offered on the products promoted, or on the retail price excluding taxes in the event that the products are offered without a discount.


Article 4: Pricing and Payment for Services


4.1 Commission calculation


The services offered by brebizz are subject to a 10% commission calculated as follows:

If a discount is applied to the product, the commission is calculated on the discount amount.
If the product is offered without a discount, the commission is calculated on the retail price excluding taxes.

4.2 Payment terms


Payment for services must be made in full at the time of the order by bank card. brebizz guarantees the security of transactions via certified payment providers, and ensures the confidentiality of its users' financial information.

4.3 Additional taxes and fees


Applicable taxes, such as VAT and any import taxes, are calculated according to the country in which the products are delivered. Users are informed of these costs before the order is finalized.

4.4 Securing payments


brebizz is committed to using the highest security standards for payment protection, including data encryption technologies and certified anti-fraud systems.


Article 5: Transparency and Communication of Amounts


5.1 Commitment to transparency


brebizz is committed to offering total transparency on the amounts invoiced to brands and influencers. Users of the platform can access clear and understandable details about the commissions that are applied to each trade.

5.2 Right to information


Any user, brand or influencer, has the right to request detailed explanations concerning the fees or amounts charged by brebizz as part of the services provided.

5.3 Price review


Commission rates may be adjusted by brebizz according to changes in the market and the services offered. Any change in rates will be communicated to users with 30 days' notice.


Article 6: Responsibility of brebizz


6.1 Intermediary role


brebizz only acts as an intermediation platform between brands and influencers. Brebizz cannot be held liable in the event of a dispute between a brand and an influencer, in particular in the event of non-compliance with commitments by one of the parties. Any complaint concerning the execution of a partnership must be addressed directly to the party concerned.

6.2 Right of suspension in case of non-compliance


However, brebizz reserves the right to suspend or ban any user who does not respect its obligations.

6.3 Blacklisting unreliable brands


If a brand does not meet its shipping commitments several times, brebizz reserves the right to **suspend or banish** its account.
The influencer can report the non-receipt of a product via their dashboard or by email.

6.4 Reporting an influencer who does not respect his commitments


brebizz does not directly manage the publication obligations of influencers.
However, a brand can report a problem to brebizz.
brebizz ** reserves the right to suspend or ban the influencer ** in case of recidivism.


Article 7: Business Status for Influencers


7.1 Obtaining business status


Influencers with a valid VAT number can obtain business status via their profile on the brebizz platform. This status allows the influencer to benefit from prices excluding taxes (HT) on the products selected for the promotion.

7.2 Benefits of business status


Corporate status allows influencers to benefit from optimized management of promotional campaigns by reducing tax burdens, while offering them better flexibility in negotiating partnerships with brands.


Article 8: Pricing and Payment for Services


8.1 Money back guarantee


brebizz is committed to offering a quality experience to its users by implementing a satisfied or reimbursed policy. Any dissatisfied user can request a refund without justification within 30 days after signing up for a partnership or placing an order.

8.2 Refund procedure


Refund requests must be submitted via the online form available on the platform. brebizz undertakes to process refund requests as soon as possible. The refund is made to the payment method used when ordering.

8.3 Consequences of reimbursement


Any request for reimbursement results in the permanent loss of access to future partnerships for the verified account concerned. Once the refund has been made, the influencer will no longer be able to participate in promotional campaigns on the brebizz platform.

8.4 Non-reimbursement of commissions


The commissions collected by brebizz for connecting influencers and brands are in no way refundable, including in the event of a dispute between a brand and an influencer. By validating a transaction on the platform, users accept this non-refund policy.

8.5 Management of cancellations and commissions


If an **influencer cancels a partnership**, they can request a **refund**.
If a **brand cancels an order after payment**, the influencer can also request a **full refund**.
**brebizz retains the referral commission**, unless the cancellation takes place **before the product is shipped**. In this case, the commission will be refunded in full.

8.6 Payment deadline


Payments are **instant** and do not require additional validation.
Influencers **see their confirmed transactions** right away**.

8.7 Terms of use and non-reimbursement of VIP status


VIP membership offers influencers the opportunity to access exclusive benefits, including an increase in the number of partnerships available per month.
However, the number of products and collaborations available on the platform may vary depending on the brands registered and the opportunities available.

  • No guarantee of product availability: The influencer acknowledges that brebizz does not guarantee either a minimum number of products or a specific volume of partnerships available at any time.
  • No refund in case of lack of products: If the product offer is temporarily reduced, this does not constitute a reason for a full or partial refund of the VIP subscription.
  • Changes to the service: brebizz reserves the right to change the benefits of VIP status without the obligation to refund, while informing subscribers in the event of major changes.



Article 9: Limitation of Partnerships and Products


9.1 Limitation of monthly partnerships


Influencers with a standard profile (free) are limited to 4 different product partnerships per month. For influencers who have subscribed to a VIP profile, this limit is increased to 20 monthly partnerships.

9.2 Product limitation per campaign


Partner brands set limits on the number of products available per promotional campaign. Influencers are required to respect these limits to ensure fair and balanced distribution of products.


Article 10: Influencer remuneration


10.1 Negotiating remuneration


Partner brands can offer specific remuneration to influencers as part of promotional campaigns. These amounts are negotiated directly between the brand and the influencer after the connection via the brebizz platform.

10.2 Pay adjustment


The remuneration amounts displayed on the platform are maximum prices. However, brands reserve the right to revise these amounts downwards according to their budget and promotional goals.


Article 11: Fiscal and accounting responsibilities


11.1 Income statement


Influencers and brands using the brebizz platform are solely responsible for their fiscal and accounting obligations. They must declare their income and pay the social and fiscal contributions applicable in their country of residence.

11.2 No responsibility on the part of brebizz


brebizz cannot be held responsible in case of non-compliance with these obligations by a user. In the event of a request from a tax authority, users will have to provide proof of their declarations.


Article 12: Conditions of Participation in the brebizz Program


12.1 Influencer Eligibility


The brebizz program is open to all influencers, whether emerging or confirmed. brebizz evaluates each application through an intelligent algorithm, taking into account the potential of the influencer according to the information provided during registration.

12.2 Levels of influence


The brebizz program is structured around three levels of influence:
- A brebizz star: for beginning influencers, with access to free products or low salaries.
- Two brebizz stars: for more established influencers, with better salaries and more attractive partnerships.
- Three brebizz stars: for confirmed influencers, with access to exclusive opportunities and maximum rewards.

12.3 Continued Development


Influencers whose profiles do not yet meet the criteria to access the opportunities offered by brebizz are encouraged to continue to develop their audience. Once the criteria are met, new partnership opportunities will be offered to them.


Article 13: User Verification


13.1 Audit Process


The verification of influencer accounts on brebizz is an essential process to guarantee the safety of users and prevent identity theft. This process assures brands that the influencer is the legitimate owner of the declared accounts.

13.2 Steps to become a verified user


The influencer must publish a specific comment on one of their social networks, including a verification code provided by brebizz. This link is then submitted via the influencer's profile on the platform for review.

13.3 Audit Results


Once the request has been submitted, brebizz performs a manual check. If the account cannot be verified, current transactions will be cancelled.

13.4 Combating fraud and identity theft


brebizz reserves the right to suspend or delete any user account suspected of fraud, identity theft or abusive use of the platform. Users are committed to providing accurate and up-to-date information. Any attempt at fraud may be subject to legal proceedings.


Article 14: Right of Withdrawal


14.1 Right of withdrawal for influencers


In accordance with current regulations, an influencer has a period of **14 days** from the confirmation of the order to exercise their right of withdrawal.

14.2 Conditions for applying the right of withdrawal


- **The right of withdrawal can only be exercised if the product has not yet been shipped by the brand. ** - If the product has already been shipped, **the influencer will have to return the product at their expense before getting a refund**.
- **Returns must be made within 14 days after the withdrawal request**. After this period, withdrawal will no longer be possible.
- **The product must be returned in its original condition**, without having been used or damaged.

14.3 Return and refund procedure


- The influencer must notify brebizz of his desire to withdraw via the customer area or by email.
- brebizz will inform the brand of the cancellation and provide the contact details for returning the product.
- Once the product has been received and verified by the brand, the refund will be made.
- If the brand refuses the return due to a damaged or used product, no refund may be required.

14.4 Products not eligible for the right of withdrawal


In accordance with the laws in force, some products cannot be subject to a right of withdrawal, in particular:
- **Personalized or custom products**.
- **Hygiene and cosmetic products that have already been opened**.
- **Perishable goods and food**.
- **Digital content after downloading**.

14.5 Retraction and commitment of brands


- **Brands must ship the product within the announced time** after validation of a partnership.
- In case of withdrawal before shipping, **the brand must cancel the order and not send the product**.
- In the event of a product not returned by the influencer, the brand may **report the abuse to brebizz, which may result in sanctions**.

If the **brand cancels a partnership after payment**, the influencer **receives a full refund**. brebizz reserves the right to **sanction brands abusing this practice** (temporary or permanent exclusion from the platform).


Article 15: Intellectual Property


15.1 Content protection


brebizz owns all intellectual property rights to all content on the platform. This includes text, images, graphics, logos, and other protected items.

15.2 Use of content


Any reproduction, modification, distribution or use of the contents without the prior written permission of brebizz is strictly prohibited.


Article 16: Protection of Personal Data


16.1 Data Protection Commitment


brebizz is committed to respecting the confidentiality and protection of users' personal data, in accordance with European and French regulations (RGPD).

16.2 Data Use


The data collected is used exclusively for the management of partnerships and platform services, and is never shared with third parties without the explicit consent of the user.

16.3 Data leak or hack In the


event of a personal data breach, brebizz undertakes to **immediately notify** the users concerned.
In the event of a massive leak, brebizz must also inform **CNIL or any competent authority**.

16.4 Deleting data


In accordance with the RGPD, **any user may request the deletion of their data**.
A brand may require the removal of its products and data from the platform.


Article 17: Conflict Resolution


17.1 Disputes and competent courts


In the event of a dispute or dispute concerning the application or interpretation of these GCS, French law applies, and the French courts have exclusive jurisdiction.

17.2 Amicable resolution


Before any legal procedure, brebizz favors the amicable resolution of conflicts via its customer service or a mediator.


Article 18: Brand Commitments


18.1 Obligation to send products


By registering on brebizz, brands undertake to send the products selected by the influencers within the agreed deadlines. Any brand that does not respect this commitment may be suspended or banned from the platform.

18.2 Confidentiality of influencer information


Brands agree not to disclose, sell or exploit the personal information of influencers obtained through brebizz. This information should only be used for the strict purpose of shipping the selected product.
Any violation of this rule will result in the immediate deletion of the brand account.

18.3 Prohibited products on the platform


Before adding a product to brebizz, brands must ensure that it meets the platform's criteria.
The following are forbidden:
- Alcohol and spirits
- Tobacco, electronic cigarettes and related accessories
- Medicinal products and food supplements with medical claims
- Products containing controlled or prohibited substances
- Weapons, ammunition and dangerous objects
- Adult or inappropriate content
- Counterfeit products or products that do not comply with legal standards
- Any other product in violation of current laws

18.4 Penalties for non-compliance with the rules


brebizz reserves the right to remove any product that does not meet these conditions. A brand that tries to add prohibited products or that does not respect its commitments may be permanently suspended from the platform.

By clicking on “Add a product”, the brand accepts these conditions and undertakes to respect these rules.



18.5 Trademark verification and required documentation


brebizz may require proof of registration (SIREN, VAT, etc.) to guarantee the authenticity of brands.
An automatic business verification system will be put in place for certain geographical areas.

18.6 Geographic restrictions and legislation


Brands choose in which countries they offer their products.
brebizz respects local regulations but cannot be held responsible if a product does not comply with a specific law of a country.

18.7 Conformity of products and descriptions


Brands are committed to providing products that comply with the descriptions displayed on the brebizz platform.
The images, data sheets, and descriptions should accurately reflect the product that will be shipped to the influencer.
Any significant change in the characteristics of the product (color, size, version, accessories included, etc.) must be clearly specified before the validation of the partnership.
If a product received does not match its description, the influencer can report a dispute to brebizz.

18.8 Responsibility in the event of a non-conforming product


If an influencer receives a product that is not as described, they can request a replacement or a full refund from the brand.
Brands are solely responsible for the conformity of the products shipped.
In the event of proven non-compliance, brebizz reserves the right to suspend the brand concerned and to prohibit it from adding new products to the platform.

18.9 Guarantee of product conformity


Brands must ensure that their products meet the legal and safety standards in force in the countries where they are shipped.
They certify that the descriptions, options and technical characteristics displayed are authentic and verified.
Any attempt at deception, false advertising or erroneous description may result in a permanent suspension of the brand's account on brebizz.

18.10 Management of faulty products


In the event of receiving a defective or broken product, the influencer should contact the brand directly to report the problem and arrange for a possible replacement or refund.
brebizz does not intervene in the management of returns, exchanges or guarantees of products. Any complaint must be sent directly to the brand concerned according to its own after-sales service conditions.
If a brand refuses to respond to legitimate requests from an influencer concerning a defective product, brebizz reserves the right to suspend or ban the brand from the platform.

18.11 Lack of guarantee by brebizz


brebizz does not provide any guarantee on the products offered by partner brands.
Influencers should refer to the manufacturer's warranties or the brand's after-sales service conditions for any request for repair, replacement or reimbursement.
No intervention, support or financial compensation may be requested from brebizz in the event of a defective or non-functional product.

18.12 Inventory Management and Product Availability


Brands using brebizz undertake to indicate real and updated stock in real time for products offered to influencers.

18.13 Inventory Update Commitment


- Brands must guarantee the availability of the products offered on the platform and update the stock according to the quantities actually available.
- Any product that is out of stock must be immediately removed from the selection or made unavailable to avoid any broken commitment to an influencer.
- Inventory management is fully editable in real time via the product management interface in the section dedicated to brands.

18.14 Responsibility for incorrect stock


If a brand does not fulfill an order due to a misfilled stock or an unreported shortage:
- The influencer has the right to cancel the partnership without compensation, and no commitment can be imposed on him.
- brebizz reserves the right to suspend the brand in the event of repeated failures to update stocks.
- Any brand abusing the system (broken promises, unavailable products displayed as available) may be blacklisted from the platform.

18.15 Real-time inventory display and management


- Inventory can be managed and updated in real time by brands in the “Product Management” section.
- A follow-up of the remaining quantities is available so that the brand can anticipate and avoid cancellations.
- In case of high demand, the brand should quickly adjust the stock or deactivate the product temporarily to avoid unfulfilled orders.

18.16 Addition and validation of new product categories


When a brand offers a product that requires the creation of a new category or sub-category, brebizz reserves the right to validate, translate and illustrate this category before it is visible on the platform.

18.17 Deadline for validating new categories


- Products added to a new category remain accessible via search, but will not be immediately visible in the category tree until validation has been completed.
- No specific deadline is guaranteed for the validation of new categories and sub-categories. The process may vary depending on the volume of requests and the resources available.
- brebizz reserves the right to modify, merge or refuse a new category or sub-category if it is deemed inappropriate or irrelevant for the platform.

18.18 Availability of products awaiting category


- Products added to a category pending validation will be visible via the search and can be ordered by influencers.
- As soon as the category is validated, it will be officially integrated into the navigation and search filters.
- In case of refusal of a new category, the associated products must be reclassified into an existing category before they can continue to be offered.


Article 19: Rules and Commitments of Influencers


19.1 Consent to the transmission of data to brands


By selecting a product on brebizz, the influencer accepts that his contact details (name, address, telephone, email) be transmitted to the brand concerned. This information is used exclusively for sending the product and should not be used for other purposes by the brand.

19.2 Prohibited partnerships


In accordance with law no. 2023-451 of June 9, 2023, certain partnerships are prohibited on brebizz.
The following collaborations are prohibited:
- Medical procedures and health products (cosmetic surgery, medications, unauthorized dietary supplements)
- Risky financial products (cryptocurrencies, binary options, dubious trading systems)
- Tobacco, alcohol and other controlled substances
- Illegal gambling and betting
- Counterfeit products or products that do not comply with legal standards
- Misleading content or aggressive commercial practices

19.3 Legal obligations of influencers


- Mandatory mention of advertising: Any commercial collaboration must be clearly indicated (#Publicité, #Sponsorisé).
- Transparency and honesty: The influencer is committed to providing accurate information and not misleading their audience.
- Compliance with sectoral regulations: Some sectors impose specific rules to be respected.

19.4 Penalties for non-compliance


brebizz reserves the right to suspend any influencer who does not comply with these legal obligations. In the event of reporting non-compliant content, an investigation will be conducted and may result in a permanent suspension of the account.

By clicking on “Accept partnerships”, the influencer acknowledges having read these obligations and undertakes to respect them.


19.5 Influencer engagement after receiving a product


By selecting a product via the brebizz platform, the influencer undertakes to respect the terms of the partnership and to publish promotional content in line with the expectations of the brand within the agreed deadlines. Any non-execution may result in sanctions, including account suspension.

19.6 Minimum Age and Enrollment Restrictions


Registration for brebizz is reserved for adults (18 years and over).
Minors cannot register, even with parental permission.

19.7 Commitment after receiving the product


Once a product has been selected, the influencer undertakes to respect his publication commitment.
In the event of a breach, brebizz may apply sanctions, including account suspension.

19.8 Non-conforming or defective products


If a product received does not match the description provided on the brebizz platform (model error, color, size, missing options) or has a malfunction, the influencer must:
- Contact the brand directly within 7 calendar days of receiving the product.
- Describe the problem precisely (photos, videos or any element justifying the non-compliance or defect).
- Request an exchange or a refund according to the conditions of the brand.

19.9 Brebizz's lack of responsibility in managing returns


brebizz is not responsible for products sent by brands and is not involved in the management of returns, exchanges or refunds.
The influencer acknowledges that any request for reimbursement or replacement must be sent directly to the brand concerned.
brebizz cannot be held responsible in case of refusal of support by the brand.

19.10 Reporting trademarks in case of litigation


If a brand does not respond to an influencer's complaints about a non-compliant or defective product, the influencer can report the brand to brebizz via their dashboard or by email.
After verification, brebizz reserves the right to suspend or ban the brand from the platform in the event of repeated breaches.

19.11 Product Warranty


The products obtained via the brebizz platform are provided either free of charge or at a discount as part of a promotional partnership. Consequently, brands are not required to apply a legal or commercial guarantee on these products.

However, some brands may choose to offer a manufacturer's warranty according to their internal policies and depending on the country of origin of the product. The influencer recognizes that:
- The guarantee is not systematic and depends on the goodwill of the brand.
- Legal guarantees vary by country and may not apply to products obtained through a promotional partnership.
- In the event of a problem requiring a guarantee, the influencer should contact the brand directly to check if support is possible.

19.12 Brebizz's absence of liability for guarantees


brebizz does not provide any guarantee on products sent by brands and cannot be held responsible in the event of failure to take care of a product that is defective or does not meet the expectations of the influencer.
The influencer accepts these conditions by validating a partnership on the platform and understands that traditional guarantees may not apply to products received as part of promotional collaborations.

19.13 Recommendation before choosing a product


Before selecting a product, the influencer is invited to:
- Check the characteristics of the product and ensure that they correspond to your expectations.
- Inquire with the brand about the applicable warranty and after-sales service policy.
- Accept that the products may not be covered by a legal or commercial warranty.

19.14 Product warranty and conformity


The products obtained via brebizz are provided as part of a promotional partnership, either free of charge or at a discount. These products are not necessarily covered by a legal or commercial warranty.

The influencer recognizes that:
- The warranty is not automatic and depends on the brand's policy.
- Legal guarantees vary by country and do not always apply to products obtained for free or at a significant discount.
- In the event of a problem requiring a guarantee or an exchange, the influencer should contact the brand directly.

19.15 Non-compliant or defective product


If a product received does not match its description, is incomplete or has a defect:
- The influencer must contact the brand to report the problem and try to find a solution (exchange, replacement, commercial gesture).
- brebizz does not manage returns and cannot be held responsible for defects or non-conformities of products sent by brands.
- No financial compensation or reimbursement can be requested from brebizz.

19.16 Brand commitment to product compliance


Brands registered on brebizz are committed to:
- Present products that conform to their description, with accurate information on technical characteristics, options and product quality.
- Ship products in good condition, functional and corresponding to the commitments made with the influencer.
- Specify whether there is an applicable warranty and its conditions (duration, possible coverage by the manufacturer, after-sales service available or not).

19.17 Verification prior to product selection


Before choosing a product on brebizz, the influencer is encouraged to:
- Read the product description carefully to make sure it meets your expectations.
- Check if a warranty is indicated in the product sheet or contact the brand for more information.
- Accept that some products do not have any warranty, and that any exchange or repair will have to be negotiated directly with the brand.


Article 20: Changes to the GTC


20.1 Right to change


brebizz reserves the right to modify these GTC at any time, to adapt to legislative or service changes.

20.2 Notification of changes


Users will be notified of the changes by email or via a notification on the platform.


Article 21: Modification or cessation of services


21.1 Evolution of services


brebizz reserves the right to modify, suspend or stop all or part of its services at any time, without notice.

21.2 No compensation possible


In the event of cessation of services, no reimbursement or compensation may be required by users.

21.3 Modification of the GTC and information deadlines


brebizz reserves the right to modify the GTC at any time.
A **30-day notice ** will be applied for any changes affecting users.
Users will be **notified by email and via a banner on the site**.

21.4 Consequences of a permanent closure of brebizz


The **current partnerships will be honored**, but **no new partnerships can be initiated**.
**User data will be delete** in accordance with the GDPR.
**No refunds** will be possible after closing.

21.3 Closing of brebizz and impact on VIP subscriptions


In the event of permanent closure of Brebizz:

  • Existing VIP memberships will not be refunded, even partially.
  • No extension of service may be required.
  • Ongoing partnerships can be finalized, but no new partnerships can be initiated.
  • There will be no automatic renewals. All subscriptions will be definitively closed on the effective date of closure of the platform

The influencer accepts these conditions by subscribing to a VIP subscription and acknowledges that no refund or compensation may be requested in the event of a closure of the platform or a temporary decrease in the number of products available.


Article 22: Acceptance of the Conditions


By registering on the platform and validating any order or partnership, the user accepts these General Terms and Conditions of Sale without reservation.
